These Terms of Service ("Terms") govern your use of ShipScanner (the "Service") operated by Talya Global Lojistik Hizmetleri ("we", "us", "our"). By creating an account or otherwise using the Service you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. Accounts must be registered with accurate information and used by the person or organisation named at registration.
2. Accounts and security
You are responsible for safeguarding your password and for any activity that occurs under your account. Notify us at info@talyasmart.com immediately if you suspect unauthorised access.
3. The Service
ShipScanner aggregates ocean container schedules, container tracking, carrier metadata and rate signals from third-party carriers and data providers. The data is provided on a best-effort basis and may contain inaccuracies. You agree to verify time-critical information (departure, arrival, customs status) directly with the carrier before acting on it.
4. Acceptable use
You agree not to:
- Reverse-engineer, scrape or systematically download Service data beyond your subscription quota.
- Resell, sublicense or re-publish Service data without a written commercial agreement.
- Use the Service to ship, broker or enable cargo that is illegal under applicable export-control, sanctions or dual-use regulations.
- Probe, scan or test the vulnerability of the Service without written authorisation.
- Use the Service in a way that overloads our infrastructure or degrades it for other users.
5. Subscription, fees and renewal
Paid plans are billed monthly in advance through Stripe. Subscriptions renew automatically until cancelled from your account billing page. Refunds for partial periods are not provided except where required by law. Quotas (shipment bookings, schedule searches, tracking lookups) reset on the first day of each calendar month at 00:00 UTC.
Prices may change. We will give at least 14 days' notice for any price increase that affects your subscription, by email and through an in-app banner.
6. Free tier
The Free tier is offered subject to identity verification (email and phone). We may rate-limit, suspend or withdraw the Free tier at any time without notice if we detect abuse, automation or sustained over-quota use.
7. Intellectual property
ShipScanner, the ShipScanner mark, the platform UI, brand assets, code, documentation and the curated databases we maintain (port registry, carrier registry) are our intellectual property or that of our licensors. Carrier logos, names and trademarks shown on the Service remain the property of the respective carriers and are used for informational reference only.
8. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by applicable law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted availability. We do not guarantee that the Service will be error-free, that defects will be corrected, or that the underlying carrier data will be complete or current.
9. Limitation of liability
To the maximum extent permitted by applicable law our aggregate liability arising out of or related to the Service will not exceed the greater of (a) the fees you paid us in the twelve (12) months immediately preceding the event giving rise to the claim or (b) one hundred US dollars (USD 100). We are not liable for indirect, incidental, special, consequential or punitive damages, including loss of profit, cargo, revenue, goodwill or data.
10. Termination
You may cancel your account at any time from the billing page or by emailing us. We may suspend or terminate your account if you breach these Terms, if your payment fails after reasonable notice, or if continuing to serve you would expose us to legal risk. On termination you lose access to paid features; we will keep your account record for the period required by law and then delete it.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email or a prominent in-app banner at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
12. Governing law and venue
These Terms are governed by the laws of the Republic of Türkiye. Any dispute that cannot be resolved through good-faith negotiation will be submitted to the exclusive jurisdiction of the courts and execution offices of Istanbul (Çağlayan), Türkiye.
